Second marriage asset protection: What you need to know

Of paramount importance for many people in a second marriage is how to protect their assets if their relationship breaks down, or in the event of their death. Although second marriages bring a level of complexity, there are a number of strategies that you can implement to ensure that your assets are protected.

Let’s explore some of the options available to you and what you need to know to protect your assets.

Binding Financial Agreement

A Binding Financial Agreement, often referred to as a pre-nup, allows you and your spouse to put in place a legal agreement which outlines how your assets will be dealt with in the event that your relationship breaks down. Should you wish, it can also extend to the provision of financial support for either party. The intention is for each party to protect their own assets, and such agreements can be put in place prior to a marriage or during a marriage if both parties consent.

Like any legal document, a Binding Financial Agreement needs to be well drafted to ensure that it encompasses all relevant information, and it is important that you seek the advice of a family lawyer to assist you with putting this important document in place.

Joint Assets v Individual Assets

The manner in which you hold your assets is of paramount importance. All joint assets pass to the surviving party. If you and your spouse own a property as joint proprietors upon your death this property will automatically pass to your spouse. By changing the manner in which you hold the property from joint proprietors to tenants in common allows you and your spouse to deal with your individual interest in the property in your respective Wills.

Additionally, you need to be mindful of any bank accounts or other investments that you hold jointly with your spouse as these are not individual assets that you can make provision for and will pass to your spouse upon your death.

Your Will

It is imperative that you put a Will in place that is reflective of your current circumstances and adequately provides for both your spouse and your children from a previous relationship in the manner that you desire. For many parents in second marriages with children from a previous relationship, protecting their children’s inheritance is of paramount importance.

Discretionary Testamentary Trusts which are created in accordance with the provisions of your Will, can make provision for your spouse during their lifetime, whilst also ensuring that most of your assets go to your children.

If you are the sole registered proprietor of your residence in which you and your spouse reside you may make provision in your Will providing a life interest in your residence to your spouse subject to some conditions being adhered to. This will allow your spouse to reside in your residence for the duration of their life then subsequent to their death the property may then pass to your children.

Dying without a valid Will in place deems that you died intestate, and your assets will be distributed in accordance with a government formula and may not end up with the people who you would like to receive them. Your spouse would be entitled to a share of your assets, however this may not have been your intention, or the share that they would receive may be significantly more than you would like them to receive.

It is therefore crucial that you take the time to put a well drafted Will in place so that your assets pass to those who you would like to receive them upon your death.

Mutual Wills Agreement

A Mutual Wills Agreement is a separate document to your Will and essentially is an agreement between you and your spouse that both of you will not change your Will without the consent of the your spouse or their legal personal representative upon their death.

This document is intended to prevent the remaining spouse from altering their Will and disinheriting step-children or making other adverse changes to their Will.

The Right People in Key Roles

The roles of executor of your Will and your attorney in respect to your Power of Attorney documents are important roles and it is paramount that you appoint trusted people to undertake these roles as essentially you are handing control of your assets to those who assume these roles.

Your attorney is entrusted to look after your finances and provide the best care for you in the event that you become incapacitated so you need to choose wisely.

Communication is Crucial

It is important that there is transparency for you and your family. By having important conversations with your spouse and children you can openly discuss your intentions and expectations so that all parties are relevantly informed and fully understand what your wishes are and what you have put in place.

In order to evaluate the best options for you it is important that you obtain the appropriate professional advice to determine which is the best strategy for your own individual circumstances so that the relevant documents are put in place which offer you the best asset protection possible.

Melisa Sloan is principal of Madison Sloan Lawyers and author of Big Moments: Expert Advice for Conquering those moments that define us. www.melisasloan.com.au

Michael Caine shares his secrets to a long life

Michael Caine has shared his top three tips for living a long, happy and healthy life.

While promoting his new movie The Great Escaper, the 90-year-old Hollywood legend credited his nine decades of life to three things.

He told the Daily Mail, "Younger wives, no snacking and wear trainers at all times."

Caine then quickly added, "And you have to be careful not to fall down."

"Happens all the time. You have to just get up and carry on."

Elsewhere in the candid interview, Caine explained how much the business of movie making has changed since his big break, discussing the relatively new phenomenon of having intimacy coordinators on set for love scenes.

Asked about the coordinators, that are not found on most film and TV sets, Caine responded, “Really? Seriously? What are they? We never had that in my day.

“Thank god I’m 90 and don’t play lovers anymore is all I can say. In my day you just did the love scene and got on with it without anyone interfering. It’s all changed.”

Caine shared that his love of movies came after he served in the army, which he believes every able man should do to serve their country.

The actor completed national service in the military himself, serving in Iserlohn, West Germany in the aftermath of World War II and seeing action in Korea.

“I think every young man should be made to do it,” he said. “It truly makes a man of you.”

He added: “I only became an actor after I left the army. I did rep for nine years then got a movie and was like, ‘f*** this! I love films more.’ I liked the money and all.”

Hugh Jackman "devastated" after marriage split

Hugh Jackman has publicly addressed his recent separation for the first time since the news surfaced on Friday September 15. Photographed while running errands in the streets of New York, Jackman's ring finger conspicuously lacked a wedding ring. When approached by a photographer about the breakup, he declined to delve into details, simply stating, "It doesn't feel quite right talking about it on the street."

The 54-year-old actor did, however, acknowledge the challenging situation with a brief remark, saying, "It's a difficult time," before courteously smiling at the photographer and resuming his errands.

His appearance comes in the wake of reports indicating that he was profoundly affected by his split from his wife of 27 years, Deborra-lee Furness. However, some sources suggest that the separation had been a long time coming.

The New York Post's Page Six section cited a source close to Jackman who said that he is “devastated” by the split and that he is “very sad".

An insider from Broadway, where Jackman returned for "The Music Man" in February 2022, revealed that the breakup wasn't a recent development, sharing, "It happened a while ago. Friends and family knew about it."

They added that there was no involvement of a third party and that the couple had gradually evolved into more like "roommates"

The announcement of their separation came as a shock to their worldwide fanbase. The couple shared their decision to part ways through a statement released via People magazine, expressing their gratitude for nearly three decades of marriage and explaining their choice to separate in pursuit of individual growth. The statement concluded by requesting privacy during this transitional phase in their lives.

“We have been blessed to share almost three decades together as husband and wife in a wonderful, loving marriage,” the statement read. “Our journey now is shifting, and we have decided to separate to pursue our individual growth.”

Jackman and Furness then added that “our family has been and always will be our highest priority” as “we undertake this next chapter with gratitude, love and kindness”.

“We greatly appreciate your understanding in respecting our privacy as our family navigates this transition in all of our lives,” the statement continued before they signed off as “Deb and Hugh Jackman”.

“This is the sole statement either of us will make,” the pair concluded.

Jackman and Furness first crossed paths while working together on the Australian miniseries Correlli in 1995. Jackman, who had previously described their connection as love at first sight, knew he wanted to marry Furness just weeks after meeting her. They tied the knot on April 11, 1996.

Their journey together included overcoming miscarriages and embarking on an IVF journey before deciding to adopt. In 2000, they welcomed their son, Oscar, into their family, followed by the adoption of their daughter, Ava, five years later.

Jackman had often openly expressed his deep affection for Furness throughout their marriage. Shortly before the news of their separation emerged, he shared a heartfelt message on Instagram celebrating their 27th wedding anniversary, professing his enduring love and admiration for his wife.

In a recent development, Furness was spotted without her wedding ring just days before the news of their separation became public.

Images: Instagram

"We love each other": Mayor marries reptile in stunning ceremony

Love comes when you least expect it and for one mayor in the small town of San Pedro Huamelula, Mexico, his match caiman he never looked back.

Victor Hugo Sosa, the mayor of the town has said “I do” to his “princess girl”, a caiman named Alicia Adriana, and his wedding speech is one for the books.

'I accept responsibility because we love each other. That is what is important. You can't have a marriage without love... I yield to marriage with the princess girl,' he vowed.

Onlookers clapped and danced in celebration as the mayor kissed and embraced his new bride who was dressed in a white gown and veil.

The ceremony is part of a 230-year tradition which symbolises the joining of humans with the divine, as she is thought to be a deity representing mother earth.

It also commemorates the day when two Indigenous groups came to peace- with the marriage between a Chontal king, now represented by the mayor, and a princess girl of the Huave Indigenous group, now represented by the female alligator.

The age-old ritual involves the reptile being taken house to house before the wedding so that residents can take their turn dancing with it.

She is later on changed into her wedding dress, which Olivia Perez was in charge of during this ceremony.

"For us, the crocodile is important because she is the princess who comes to bring us water, a good harvest, rains, so that God the Almighty Father sends us food, fish, corn, the harvest," she said.

After the wedding, the mayor dances with his bride to traditional music.

Local fishermen would also take part in the ritual and toss their nets on the ground in hopes that their marriage would bring “'good fishing, so that there is prosperity, equilibrium and ways to live in peace.”

Images: Getty, Oaxaca Informa10 Twitter

How to tell people about your divorce

While it may not be the most pleasant topic of conversation, if you’re in the midst of a separation or divorce you’ll eventually have to tell your nearest and dearest (and some relative strangers) that you are no longer part of a couple. There’s a strong chance that many of us would rather have a tooth pulled than sit down with friends and family and announce that our marriage has ended but putting off the inevitable never ends well. A lack of transparency can make it difficult to move forward while also placing you in the uncomfortable position of having to tell people at an awkward moment down the track when you may have been divorced for months but the news comes as a complete shock to them as they’re hearing it for the first time. Having a strategy for approaching conversations can be helpful, here’s what the experts recommend.

1. Tell your close friends first

There’s a strong possibility they are abreast of the situation already, at least to some extent. Sharing the official news however allows you to start the grieving process and move slowly towards closure. Your closest friends are the ones most likely to be there for you as your life changes and it’s important to let them in and lean on their support.

2. Share with your family

It can be difficult to share with your loved ones that a relationship they may have been part of for years has ended. Telling your children should be of utmost importance. Whether you do that individually or as a group is completely up to you but having an honest conversation and allowing both you and them to grieve is essential.

3. Work

While it’s not always necessary to share the minutia of your life with your workplace, you may need to fill your immediate manager in on what’s happened. Likewise, if you work within a very close knit team or are especially friendly with people at work you may want to let them know.

4. Extended family

Unless you want to subject yourself to a plethora of phone calls, an email may be best for your extended family. Keep them in the loop and let them know what’s happened so that they can offer support but don’t exhaust yourself with feeling as if you need to explain the situation to every single person in your life.

Images: Getty

“What a legend”: Groom exposes new wife’s affair during wedding speech

A groom has exposed his new wife after finding out she had been having an affair with his best man during a speech at their wedding.

The scorned groom handed out intimate photos and explicit videos of his wife and the best man together before announcing he would be “leaving now”, dropping the microphone and then walking off with his family, who had been pre-warned.

On The Unfiltered Bride podcast, wedding planners Georgina and Beth spoke about the shocking story.

Georgina said although his family knew, he wanted to go ahead with the wedding so that the bride would have to pay for all the food.

They posted a snippet of their podcast on TikTok, which quickly went viral.

Georgina said on the podcast, “I've got another story to tell you. I can't tell you who told me because I'm not really allowed to tell the story, but f**k it I'm going to tell the story anyway. So there was a wedding and they did the wedding, bride and groom got married, lovely ceremony, drinks reception, sat down for wedding breakfast, had their food, speeches after food.”

“Father of the bride does his thing, groom stands up and says, ‘Just before I properly get started, there's some envelopes coming round now. If you could all open them up. Yeah those are pictures of the bride f*****g the best man so I'll be leaving now.’ Dropped the microphone and him and all his family knew about it and left because they wanted the bride to have to pay for the food.”

Beth then asked, ”So the bride paid for everything?” To which Georgina replied, “The bride's family paid for everything.”

The video sparked numerous reactions.

“My mouth actually dropped. OMG!!!” one person said.

“I don’t blame him at all!! I’d do the same 😂😂” another added.

“But WHY did he still marry her?” a third asked.

“I admire the patience of the groom and family to get through the whole thing without slipping up once. 😅” another added.

“No justification for this ever”: Outrage over one husband’s selfish inflight arrangement

A couple in the United States have landed themselves at the centre of the internet’s attention after the wife made the shocking admission that her husband flies first class when they travel, leaving her behind in economy with their two children.

Writing to The New York Times’ ethics column, she wanted to know if she was selfish for thinking their ‘arrangement’ was unfair, noting that while he had offered a compromise of sorts, it did “not really address or solve the problem of the inherent selfishness in his thinking.”

As she explained in her message, she and her husband are avid travellers, and he “either pays for, or gets an upgrade into, the first-class cabin”. Even when they travel with their two children - who are 12 and 16 years old - he takes himself off to first class, while they remain in economy.

According to her, he justifies it to himself by explaining that it’s “because of the cost”, and that their children “might feel alone” if she were to travel up front with him.

“I feel that this is unfair,” she said. “ I don’t think our kids would mind if they were in economy plus and my husband and I sat together in first class. Is that unfair of me to want?

“My husband has suggested travelling alone on a different flight ahead of us so that we don’t feel badly about the disparity, but this does not really address or solve the problem of the inherent selfishness in his thinking. Am I wrong?”

Kwame Anthony Appiah, the ethicist who responded to her for The New York Times, was of the opinion that “a modern marriage is meant to be a pairing of equals”, with partners treating each other with respect and having equal say in the decision making process.

“Your husband has another view,” he said. “He evidently thinks that because he’s the ticket-buyer in the family, his own preferences get priority.”

And when the article was shared to social media, people from all over were quick to get in on the discussion, with most leaping to the defence of the wife.

“I’d divorce him so fast he’d never get to fly first class again until our kids were grown and through college,” one said. “There is no justification for this ever.”

“I'd be calling a divorce lawyer rather than a travel agent,” one agreed.

“Wow. And you’re still married to him?! I’d recommend booking your own flights,” came a similar response.

Meanwhile, another noted that she “just might be married to a narcissist.”

“Oooph BIG YIKES. It’s not about the flight, I’m sure this imbalance trickles into other parts of the relationship,” someone wrote.

And as another shared, “recently, my husband was offered the upgrade to first class but declined it because I couldn’t go too. We’ve been married 30 years.”

Some, however, took issue with the idea of both parents lounging in first while their children were still left behind, with one noting “she wants to upgrade but still leave the kids in economy? The pair of them sound like terrible parents.”

“Frankly, I’m blown away that this mother sees the disparity for herself,” another said, “but is perfectly comfortable experiencing privilege while treating her own children disparately.”

Images: Getty

77-year-old woman takes a happy marriage into her own hands

When it came time to walk down the aisle on her big day, Dorothy ‘Dottie’ Fideli had every box checked - except one.

No partner stood waiting at the end to exchange vows with her, and that was just the way she wanted things.

The 77 year old was, after all, marrying herself in an emotional ceremony at her O’Bannon Terrace Retirement Community, surrounded by her loved ones for her big day.

Her reasoning was very simple, as she told Today, “I said, ‘you know what, I’ve done everything else. Why not? I’m going to marry myself’.”

She wasn’t entirely alone at the altar, of course, needing someone there to oversee her all-important vows. And she had just the person in mind, turning to her home’s property manager, Rob Geiger, to do the honours.

“I came in here and I told Rob,” she explained. “I said, ‘Rob, you’re going to marry me’.”

He was surprised at first, but after Dottie explained what it was she was setting out to do, he was all too happy to step in and lend a hand.

“She is a very incredible woman and she is full of life,” he said. “She has always thought of others.”

Dottie’s daughter, Donna Pennington, was possibly her mum’s biggest fan, and eager to make her mum’s big solo dream come true.

As Dottie explained, Donna had been right onboard from the very beginning, offering to get whatever was required, including Dottie’s dress.

Donna even made sure that the wedding was properly catered and decorated, seeing to both aspects by herself, from doing all of the cooking to putting up a balloon arch in the home’s community room.

As all good weddings should, Dottie had a cake - two-tired and covered with red roses - and heart-shaped cookies, as well as finger sandwiches shaped like wedding bells.

When it came to the day itself, Dottie admitted to feeling nervous, but ultimately “really happy”.

Initially, she’d intended for it to be something her nearest and dearest had come to expect from her in her quest to make sure everyone else was smiling - though things had taken an emotional turn as the significance of her message of self-love sunk in.

As she explained it, “I do some crazy things around here just to make people laugh. When I see them all down in the dumps, I go get one of my outfits on and dress up and come down, and they smile.”

It wasn’t Dottie’s first wedding, with her first occurring back in 1965, though the former hadn’t exactly been what she’d consider “formal”.

She and her then-husband had exchanged their vows, before dashing off to home and work respectively. Dottie even noted that they’d been “doomed” from the start, as she’d opted to wear a black dress that day.

She’d gone on believing that it was too late for her to experience her big dream wedding, until her daughter proved her wrong, to Dottie’s eternal gratitude.

And now, Dottie plans on continuing on her journey of self-love, telling Today, “I’m at the point in my life where it’s about me now.

“My kids are all good, and my grandkids, one of them’s going to have a baby … and I have a set of triplets that have all graduated from college.

“So, it’s my turn to do what I want to do.”

Images: Today

Husband cheats on wife and blames her

Kerry knew her marriage “wasn’t in the best shape”, and that there was not much happening in the bedroom department. She was working full-time and busy with their kids, aged five and seven. She was also considering suggesting couples counselling to her husband.

"I knew he was preoccupied, but told me it was work stress and I believed him.”

She also noticed had a few more “business trips” than usual.

One night, realising that her husband was avoiding eye contact with her, she demanded to know what was going on.

He had been cheating on her. For six months.

He revealed that flirtation with a work colleague transformed into meeting for drinks, kissing and some “home bases”.

"He said 'I didn't have sex with her until recently' as though he thought he deserved some sort of prize.”

That’s not all he told her.

"He was like, 'Oh you must know you haven't been meeting my needs'. I was like 'I cook, and look after the kids, and carry the mental load so what the f--k do you mean?”

"He told me we'd been distant, sort of leading separate lives. I was like, really? How separate is sharing a bedroom? How separate is having two kids together? How separate is watching Succession together?”

Before he cheated, he had been counting the days since Kerry had initiated sex - while not initiating it himself - as a bizarre test.

An understandably emotional Kerry blew up at him yet he allegedly does not want the marriage to end. He has since cut off contact with the colleague apart from necessary exchanges at work.

"He doesn't seem that remorseful, though. He keeps saying how I was so distant. I still feel like he wants me to shoulder some blame.”

Kerry revealed she had issues with her self-worth that stemmed from her father.

“Now, because of the cheating, that thought keeps popping up – that maybe I'm not good enough."

If you keep lying about these 10 things, your relationship is doomed

You say you’re available, but you’re not…legally

If you’re waiting for the ‘right time’ to tell the person you’re dating that you’re married, both of your relationships are probably doomed to failure. And typically, it doesn’t matter if you’re separated, planning to (someday) divorce, or none of the above. “Lying about availability for a relationship is devastating for partners who discover their significant other has been dishonest. Sometimes people lie, and say they are single when they are not, or they may lie about whether or not they have children. This is never fair to the person being lied to, or to the people being lied about,” says marriage and family therapist, Shadeen Francis. Francis recommends telling the truth about your external romantic, and familial relationships up front, before you get involved.

You say you’re available, but you’re not…emotionally

True emotional availability requires honesty, to both yourself, and your partner, Francis says. Pretending to be ready to take it to the next level, and then either stopping short, or self-sabotaging the relationship, can be confusing and heartbreaking. If you can’t figure out how to make your relationship grow, some honest soul-searching can help. Maybe you’re trying to fit a square peg into a round hole, and just don’t want to let the person go, even though you know you won’t go the distance together. It’s also possible that you’re hauling around some baggage that is making it hard for you to fully commit. If so, a therapist can help. Either way, be honest with your partner, so that they can make the right decision for their own life – either with you, or without you.

You’re not fessing up about your past

Relationships thrive on trust. That doesn’t mean you have to spill your guts about every skeleton in your closet on the first date, but letting someone in, over time, is imperative, if you want to have a relationship that can withstand the bad times that inevitably come to everyone. “Things you should never lie about include why your last relationship ended,” says therapist, Kimberly Hershenson. “It’s important for your partner to know what went wrong for you in the past, and if you’re still continuing the same behaviours. And, that includes cheating.”

Hershenson also includes mental health issues in this list. “Knowing if you’ve struggled with depression, anxiety, or substance use is important, because it gives your partner information about potential triggers which might arise for you,” she adds.

It’s also important to let your partner know if you’ve done jail time, declared bankruptcy, dropped out of school, or have any other deep, dark secret you’d rather not share. Chances are, once you fess up, you’ll feel a new freedom, and the kind of emotional vulnerability needed to be truly loved, and loving.

Money matters

“Combining finances takes a lot of trust, and that trust is betrayed in a really painful way when partners have hidden, or outright lied, about their ability to contribute to financial stability in their relationship,” Francis says. The money conversation is integral. Without it, you can’t realistically plan for a future together. The best way to tackle this conversation is head on, whether you have debt or wealth. It’s better to come clean, and come up with a pre-nup, or other financial plan, than to lie about your bank account.

You really want (or don’t want) kids

This is a biggie. If you know that your partner wants or doesn’t want kids and your desire is the exact opposite, you’ve got to fess up about it. “Sometimes, partners overtly tell untruths about their goals, wants, and needs, in order to be flexible. This form of dishonesty can create fear, resentment, and anxiety in a relationship. When a partner does not feel free to be himself/herself, this builds up frustration over time,” says clinical psychologist, Dr Carla Marie Manly.

You cheated

“One of the worst lies couples can tell each other has to do with the single most lethal relationship threat: The Other,” says Dr Wendy L. Patrick. “Lying about spending time with another person is a death knell to a relationship, and a lie partners should never tell,” she adds. Not only do they need to know for the health of your relationship but also for their physical health, as cheating puts the other partner at risk for STDs. This honesty policy applies to emotional affairs as well as physical affairs, she adds.

You’re not ill, and pretending to be

“Couples should always be honest with one another about health. Telling your partner you are sick, injured, or terminally ill when it isn’t true (yes, this happens) is cruel and manipulative,” says Francis. “These lies are often told in order to evoke pity or guilt, ultimately with the intent of being nurtured, or taken care of, more than is warranted,” she explains.

Francis suggests thinking about your motives for this behaviour. “Ask yourself, why am I doing this? What am I hoping to gain? Am I being fair to the other person? If you are struggling to make these decisions, or find yourself telling similar lies in different relationships, recognise that this is a pattern of behaviour that can make you an unsafe person to partner with, which likely does not feel very good for you, either. Most people do not lie if they believe they have other options,” she adds.

You’re ill, and pretending not to be

Almost as bad a lie is hiding your failing health from your partner, Francis says. Many people do this to protect their significant other from the pain of dealing with a bad diagnosis, or from fear about the future. Either motive is ill-founded, according to Francis. Lying about an illness you have, even if it is terminal, robs your partner of the ability to support, and care for you, which may come back to haunt them and create guilt, later on. Whether you’re married or not, it’s ‘in sickness and in health,’ remember?

You’re pretending it’s OK with you, but it’s not – especially in bed

“Couples should never lie about anything that bothers them in the relationship, or any topic of significance,” says clinical social worker, Dr Marni Feuerman. Lying about your feelings can range from where you want to eat dinner, to sexual satisfaction. Pretending to enjoy a less than satisfactory sex life is bound to sabotage your relationship eventually. “Lying often becomes a slippery slope that becomes easier to do than telling the truth. Some people may also start to ‘compartmentalise,’ and the norm becomes to keep secrets about certain aspects of their life,” Dr Feuerman says. If you are lying about your sex life (or anything else), it’s time to get honest with your partner about your needs and desires.

It’s not me, it’s you

Your partner may feel that something is wrong and grasp at clues to try to figure out what it is. The lack of communication between the two of you may push them into behaviours such as spying, going through your wallet, or looking for information any way that they can find it. Lying, especially long-term, about any behaviour or action is wrong and unfair to your partner, Dr Feuerman says.

This article originally appeared on Reader's Digest.
